Compensation Calculator

This calculator provides an estimate of a potential recovery for an abuse survivor under the BSA’s Plan of Reorganization, subject to the amount of available funds for distribution by the proposed Settlement Trust. Funds could be available for distribution to abuse survivors as soon as early- to mid- 2022.

Expedited Distribution Option Abuse survivors may elect an expedited one-time cash payment of $3,500 if the survivor does not wish to have his claim fully evaluated by the Settlement Trust.

Abuse Claim Value Minimum Recovery The lowest amount a survivor would likely receive if certain of the proposed contributions to the Settlement Trust, including the Hartford and TCJC Settlement Contributions, become unavailable to some or all survivors. Estimated to be approximately 10% of the value of the Abuse Claim. Maximum Recovery The highest amount a survivor would likely receive if all of the proposed contributions to the Settlement Trust are available to some or all survivors. Estimated to be approximately 63% of the value of the Abuse Claim. Importantly, this percentage may increase to 100% based on the anticipated value of the significant insurance rights proposed to be contributed to the Settlement Trust.
Base Value The base value represents the standard allowed claim amount for an abuse claim in a given tier. This amount is based on historical abuse settlements and litigation outcomes.

Maximum Value The maximum value represents the maximum allowed claim amount for an abuse claim in a given tier after review under the procedures proposed to be used by the Settlement Trust and adjustment based on the “scaling factors” described in the Disclosure Statement (See the Plan of Reorganization here, page 92 of 495, for further detail).
